          We agree with the view taken by the State Commission that the petitioner was guilty of stealing electricity.  Relevant portion of the report of the ME Laboratory is as under :

“It was found on outer examination of meter that on 100th and 1000th window are having signs scratches.  Meter was opened after breaking its six seals.  After opening inner clump of the meter cover, it was found that there was gap in between body of meter cover and collar affixing glass and meter cover and scratches and upper disc of meter is scratchy on its upper side.  1000th figure of Counter Gear of meter also found to bear scratches on figures 5 and 7.  this clearly proves that consumer had been infringing inside meter with some outside object and reducing actual consumption.  This is a case of theft.  Meter seals have been rapped in paper and meter had been repacked in the cardboard box and paper seal No.428514 dated 9.1.02 has been affixed on it.  Undersigned on it.  Meter is entrusted to J.E. Harbhajan Singh for safe custody after packing it.”

 

          A bare perusal of the report shows that the petitioner had been infringing inside meter with some outside object for reducing actual consumption.  We find no infirmity in the order passed by the State Commission.  Dismissed.
