ORDER

R.P. No.2987/2007

Petitioner was the opposite party before the District Forum.
Complainant/respondents, who are senior citizens, had a locker with the petitioner bank. On 18.5.2005, they approached the bank to operate the locker at 15.50 hrs. After operating the locker, they found that the exit door or the locker room was locked. They raised a big hue and cry but nobody listened. Thereafter, they telephoned the police, who after some time took them out of the locker room. Alleging deficiency in service on the part of the bank, complaint was filed before the District Forum.
District Forum allowed the complaint and directed the petitioner to pay a compensation of Rs.1 lakh each to both the respondents along with costs of Rs.3,000/-.
Petitioner, being aggrieved, filed the appeal before the State Commission, which has been dismissed.
While admitting the revision petition on 11.9.2007, operation of the impugned order was stayed subject to deposit of Rs.50,000/- with this Commission within 3 weeks. Deposited amount was directed to be released in favour of the respondents/complainants in equal proportions. Petitioner deposited the amount which has been paid to the respondents.
Facts are not in dispute except that, according to the petitioner, respondents remained in the locker room for 5 minutes whereas, according to the respondents, they remained in the locker room for 20 minutes. Keeping in view the facts and circumstances of the case, we are of the opinion that the sum of Rs.1 lakh awarded by way of compensation to each of the respondents is on the higher side and ends of justice would be met by awarding a total compensation of Rs.50,000/- to the respondents, i.e., Rs.25,000/- to each of the respondent.
Amounts have already been paid to the respondents and the decree stands satisfied.
Revision petition stands disposed of in above terms.

Petitioner/complainants have filed the revision petition seeking enhancement of compensation.  In view of the order passed in R.P. No.2987/2007, this revision petition has been infructuous and is dismissed as such.
