This complainant’s appeal is directed against the order dated December 20th, 2016 passed by District Consumer Disputes Redressal Forum, Sirsa (for short ‘District Forum’), whereby complaint was dismissed.
2. Surender Singh-complainant maintained saving account No.4674001500032761 with Punjab National Bank, Sirsa-opposite party No.1. A debit card was issued to him. The grievance of the complainant was that the Automated Teller Machines (ATMs) of the opposite parties used to breakdown frequently, due to which, he and other customers faced inconvenience. The complainant moved a complaint to the opposite party No.1 but the officials of the opposite party No.1 misbehaved with him. Hence, he filed complaint under Section 12 of the Consumer Protection Act, 1986 and claimed compensation of Rs.1 lac.
3. The complainant in order to prove his case has produced two ATM withdrawal receipts (Exhibits C4 and C5) but it was not proved that the cash was not dispensed from the ATM. On the other hand, the opposite parties have placed on record ledger inquiry of the complainant’s account (Exhibit R2), which clearly shows that the complainant had been withdrawing the cash through ATM since February 11th, 2010. Besides this, the complainant in his complaint did not mention the date, time and place where he operated the ATMs. So, it cannot be said from any angle that there was any deficiency in service on the part of the opposite parties. In view of this, District Forum has rightly dismissed the complaint. The appeal consequently fails and is hereby dismissed.
