ORDER

1.         An application has been moved on behalf of OP praying therein that it be permitted to deposit a sum of Rs.1,00,000/- as per order dated 5.10.2012 passed by the Hon’ble National Commission.

2.         Vide its order dated 5.10.2012, the Hon’ble National Commission has stayed the operation of the impugned order subject to deposit of Rs.1,00,000/- within a period of four weeks. The OP wants to deposit a sum of Rs.1,00,000/- in compliance of the said order. So, it is ordered that the draft of Rs.1,00,000/- bearing No.171316, dated 20.10.2012 drawn in favour of President District Consumer Disputes Redressal Forum, Chandigarh, on Punjab National Bank, be deposited in the account of District Forum, in the shape of F.D.R, having maximum interest, for a period of one year to be renewed from time to time, if needed.

3.         Counsel for complainant has made the following statement, recorded separately:-

“My power of attorney is on the main file. In view of the stay order dated 5.10.2012 granted by the Hon’ble National Commission, the complainant does not want to press this criminal complaint. It be dismissed as withdrawn. However, the complainant reserves her right to file a fresh criminal complaint/execution in terms of the order to be passed by the Hon’ble National Commission.”

 

4.         In view of the above statement of counsel for complainant, this criminal complaint is dismissed as withdrawn with liberty to file a fresh criminal complaint/execution in terms of the order to be passed by the Hon’ble National Commission, as per law.

5.         Certified copy of this order be communicated to the parties free of cost. After compliance file be consigned.
