ORDER

Counsel for the parties heard.  Counsel for the petitioner wants to withdraw this case and liberty to file the case before the Civil Court is prayed for.

As already ordered by the State Commission, liberty is given.  The case be filed as per Law in accordance with the judgment of the Apex Court in the case of “Laxmi Engineering Works v P.S.G. Industrial Institute [(1995) 3 SCC 583]” so far as the matter of limitation is concerned.

The matter stands dismissed as withdrawn.
