PER JUSTICE JASBIR SINGH (RETD.), PRESIDENT
Appellant/Decree holder/Complainant has filed this appeal against order dated 10.7.2018 passed by the District Consumer Disputes Redressal Forum-I, U.T., Chandigarh (in short the Forum only), dismissing execution application bearing No.73 of 2018 filed by him.
2. Appellant/Complainant had filed a consumer complaint before the Forum on 1.11.2017 which was allowed on 21.3.2018 giving him the following relief ;
i. To make separate entries in the pass-book for Complainant’s pension, his family pension and the TDS deducted.
ii To supply all the record pertaining to the Complainant’s account in Hard copy and if any information is supplied through a soft copy i.e. E-mails or text messaging then it should be confirmed by a hard copy.
iii To pay Rs.5,000/- as compensation on account of deficiency in service and causing mental and physical harassment to the Complainant;
- To pay to the complainants Rs.5,000/- as costs of litigation.
3. It was grievance of the complainant that credit of amount in his bank account qua family pension and pension of his deceased wife was not shown in a correct manner. Only single entry was made to show the amount credited. Above fact was brought to the notice of the respondents/OPs. When they failed to give response, a consumer complaint was filed before the Forum, in which abovementioned relief was granted in favour of the appellant/complainant.
4. The said order dated 21.3.2018 was challenged by the OPs before this Commission. Their appeal bearing No.138 of 2018 was dismissed vide order dated 29.5.2018. When no compliance was made as per directions issued, the appellant/complainant filed execution application bearing No.73 of 2018 before the Forum to take appropriate action.
5. Upon notice, affidavit was filed by the Judgment Debtor that necessary compliance has been made to the order passed. The execution application was dismissed having been fully satisfied and making out no case against the judgment debtor in terms of Section-27 of the Consumer Protection Act,1986.
6. When passing above order, further direction was issued to the respondents to supply pension monthly slip to the complainant on or before 5th of each calendar month showing the break-up of entries of pension, other allowances and TDS deducted etc. We have gone through the order passed. It is perfectly justified. It was noticed by the Forum that there was sufficient compliance with the order passed. Awarded amount stood paid. In view of above, no case is made out to interfere in the order, under challenge.
7. For the reasons recorded above, the appeal, being devoid of merit, must fail, and the same is dismissed, at the preliminary stage, with no order as to costs. The order of the District Forum is upheld.
8. Certified copies of this order, be sent to the parties, free of charge.
9. The file be consigned to Record Room, after completion.
