Complainant has filed the copy of Civil Appeal No. 7385 of 2009 along with annexures filed before the Supreme Court. In para no. 42 of the Memo of Appeal as it is stated that on the issue of rate of interest awarded and the issue of maturity value of the FDR as awarded, the complainant/appellant has filed a review petition before this Commission, on which notice has been issued and the review application is fixed for hearing on 18.9.2010. By the order dated 27.11.2009, the Apex court has dismissed the said appeal. Ms. Saigal points out that on internal page no.8 of the order dated 30.7.2009, this Commission has held the complainant entitled to the maturity value of the FDR and interest @ 10% per annum. However, in the operative portion of the order, the direction has been made to the opposite party to pay the amount of FDR instead of Rs.5,34,971.50 by mistake. After having heard Shri  Ahuja, we find that mistake has kept in the operative portion of the order and instead of the amount of Rs.5,34,971.50, the amount of Rs.4,01,100/- has been mentioned. Complainant is, however, not entitled to compound interest. Accordingly, the application is allowed modifying the operative portion of the order to the effect that the complainant is entitled to the maturity value of Rs.5,34,971.50 instead of value of Rs.4,01,100/- for which the FDR was taken out. Application stands disposed of.
