Present:   Shri Angrish Kumar Sharma, Adv. for complainant.

                Shri Arvind Bhardwaj, Advocate for respondent No. 2.

            On the basis of even date application filed by the complainant. Case taken up on today by way of application in hand, complainant has expressed and intension to compromise the matter and in the process respondent No. 2 through its counsel agreed to make payment of compensation, in lump sum in the sum of Rs. 4,00,000/- (four lac) within the period of 30 days from today and in default of it, the award amount of Rs. 4,00,000/- (four lac) shall be carry on interest @ 7% simple from the date of order. Statement of counsel for the respondent No. 2 and counsel for the complainant recorded.

            Hence, in view of statement of the counsel for the complainant as well as respondent No. 2 without commenting on the conduct of any of the party. This complaint is accepted holding the respondent No. 2 liable to pay compensation in the sum of Rs. 4,00,000/- (four lac) within the period of 30 day from today in default of it respondent No. 2 shall be liable to pay interest @ 7 % per annum on the award amount of Rs. 4,00,000/- (four lac) from the date of order till actual realization. In addition to its Provision of Section 25/27 of the Consumer Protection Act, 1986 may be invoked against respondent No. 2. The complaint qua respondent No. 1 is dismissed. Parties are left to their own costs. File be consigned to the records.
