ORDER

(Per Shri S.R.Khanzode, Hon’ble Presiding Judicial Member)

(1)               Heard learned counsel for the revisionist.  This revision is filed against the order dated 06/12/2012 whereby request of the revisionist to continue ad interim injunction granted on 27/06/2011 was rejected.  The forum has observed that such continuation is not necessary,  since in the reply to an application for stay, the opponent already undertook not close the account unless a prior notice is given.

(2)               We find that the purpose of the ad interim relief obtained by order dated 27/06/2011 is already served, since the opponent vide their written reply undertook not to close the account without giving any notice.  Further more, in view of Regulation No. 17 of the Consumer Protection Regulations, 2005 ad interim order dated 27/06/2011 stood automatically vacated on expiry of 45 days and, therefore, on 06/12/2012 said ad interim order was no more effective and the question of its extension would not arise.  Considering the facts and circumstances, it is not a case where it would be appropriate to invoke a revisional jurisdiction of this Commission.  Holding accordingly, we pass the following order.

ORDER

(1)     Revision petition is not admitted and disposed off accordingly.

Pronounced on 04th January, 2013.
