It is a case where the matter which is raised before this Commission had earlier gone before Debt Recovery Tribunal, Civil Court etc. The complainant/Opposite Party are litigating for the last so many years. Those orders have become final. The Opposite Party Bank has intimated the complainant that on the files of the court original documents were not available.

                   Faced with the situation, Counsel for the complainant wishes to withdraw this complaint with liberty to avail any other remedy other than Consumer Fora.

                   Ordered accordingly.

                   Spare copy be retained for the office record and all the three original paper-books be returned to the Counsel for the decree holders.

                   Certified copies of the order be sent to the parties free of charge.
