Sh. Deepak Ahluwalia, learned counsel for the complainant has appeared and present the withdrawal application.
Learned counsel for the complainant has contended that the opposite party has paid the entire amount, which was illegally debited to the account of the complainant; as the Govt. Medical College has no grievance against the opposite party; therefore, the complainant be permitted to withdraw the consumer complaint.
None is responding on behalf of the opposite party inspite of several calls; we have perused the record. Paper No. 48 reveals that the Principal of Govt. Medical College, Haldwani on dated 05.09.2018 has earlier given an application stating herein that the complainant has received the total amount of Rs. 20,63,999/- (Rupees Twenty Lakh Sixty Three Thousand Nine Hundred Ninety Nine Only) through cash order No. UPX 808614, therefore, the complainant has no claim pending with the Punjab National Bank, Haldwani, thus, the above noting also shows that the complainant has received all the amount about which the complainant had brought this consumer complaint.
Now the relief as mentioned in the consumer complaint has already obtained by the complainant, hence, the Commission considers fit and proper to withdraw this consumer complaint on the basis of withdrawal application.
Accordingly, the consumer complaint is dismissed as withdrawn.
