Final Order / Judgement

          During the course of proceeding, it has come to the knowledge of this Forum that on the last date of hearing i.e.on 12.5.2017, Sh.Sumesh Sharma Adv.counsel for the opposite party produced on record statement of account of the complainant showing the entry of Rs.30000/- reversed in the account of the complainant. Today, Sh.Deepinder Singh, Adv.counsel for the complainant has stated at bar that opposite party has compelled the complainant to file the present complaint and amount of Rs. 30000/- has been reversed in the account of the complainant after filing of the present complaint which amounts to deficiency in service on the part of the opposite party. He pressed for compensation and litigation expenses.

          In our considered view, opposite party is deficient in providing service to the complainant in time and amount of Rs.30000/- has been reversed in the account of the complainant during the pendency of the complainant i.e.on 11.5.2017 i.e.after 5 months from the date of filing of complaint. It amounts to deficiency in service on the part of the opposite party and it entitled the complainant for compensation and litigation expenses.

          Consequently, instant complaint is ordered to be disposed of with directions to the opposite party to deposit of Rs.2000/- in the Consumer Legal Aid Account of this account and to pay Rs.2000/- as compensation and Rs.1000/- as litigation expenses to the complainant within a period of 15 days from the date of receipt of copy of order. Copy of the order be furnished to the parties free of costs. File be consigned to the record room.
