Final Order / Judgement

Per Shri B.A.Shaikh, Hon’ble Presiding Member.

1.      None for the appellant and respondent No 3 is present. Respondent Nos.1 and 4 are already proceeded ex-parte. Perusal of the record and proceedings of the appeal shows that the appeal is of the year 2003 and the appellants have not filed written notes of arguments though last chance was given. The respondent No.2 died during the pendency of the appeal and his four legal representatives (L.Rs.) have been already brought on record of the appeal.

2.      None appeared for the appellant on last three dates i.e. on 06/12/2017, 19/12/2017 and 30/01/2018 for hearing. The last chance was granted to the appellant on 30/01/2018 for filing written notes of arguments.

3.      We find that already several chances have been granted to the appellant for making progress in the appeal. We find that as several chances including the last chance have been granted, now there is no question of granting further time to appellant. Hence the appeal deserves to be dismissed in default. Hence the appeal is dismissed in default.
