18.01.2018 Present:- Sh.K.S Gill, counsel for complainant.

 

IPO worth Rs.500/- deposited with the complaint as fee be deposited in the relevant head as per notification dated.10.02.2005 by the Superintendent.

Heard on the point of admission of complaint.

Brief facts of the complaint are that on 15.11.2017, the complainant approached opposite party No.2 for his treatment of cough. Opposite party No.2 prescribed some tests, which were got done. Thereafter opposite party No.2 prescribed medicines and his compounder took the same from opposite party No.1 as both clinic and medicine shops are in front of each other. Opposite party No.2 received an amount of Rs.600/- and directed the complainant that Ceftrox-S is an injection and he can get inject the same from any doctor in his village on next date. Opposite party No.2 also prescribed other medicines of 10 tablets.

It is alleged that the complainant took the tablets in the night, which effected on his health. On next day i.e. 16.11.2017, he went to the medicine shop for injecting the injection of Ceftrox-S and when the person of the medical shop saw the date, he was surprise that the date has already expired on 9/2017. He refused to inject the injection.

The crux of the allegation of the complainant is that he was injected the expired injection. Hence, this complaint is against both opposite parties.

We have given careful consideration to these submission.

The complainant has not produced on record any prescription slip issued by opposite party No.2 prescribing the medicines or tests. He has not brought on record any bill issued by opposite party No.1. It is also not case of the complainant that he purchased the medicines directly from opposite party No.1 and paid price to opposite party No.1. In these circumstances, there is no documentary evidence to prima-facie prove the case of the complainant. Hence, there is no ground to proceed this complaint. As such, the complaint is not maintainable and stands dismissed.

File be consigned to the record room and copy of this order be sent to the complainant free of cost.
