This is an application for restoration of the appeal. Counsel for respondent states that respondent has no objection if application is allowed. In view of the above statement given by counsel for respondent and for the reasons mentioned in the application, application is allowed subject to payment of cost of Rs.2,500/- to be paid by the appellant to the respondent, within four weeks.
