ORDER.

 1          The complainant has preferred this case alleging deficiency in service by the Ops.  for non – providing  service during warranty  period. The complainant had purchased a Solar Home Light system (640 watt) from the OP. No. 1 for a consideration of Rs 54000/- with the financial

assistance of Oriental Bank of commerce. The said system was installed on dt.07.03.2014. After

use  of  2years the Complainant found problem in the said system to which he had requested the OPs for repair. The complainant alleges that, after repair also the system is not functioning properly and the issue has not been shorted out. Hence the complainant has preferred this case.

2         Although the OPs have received the notice, neither they have appeared nor have filed their version and hence they are set experte vide order dt. 12.04.2018 and 06.07.2018.

 3        Complainant is present in person. Heard. Perused the document filed by the complainant. During course of heaving the complainant submitted that, during pendency of the case, the solar system has been replaced with a new one and already installed by the OPs, hence at present there is no issue. Further the complainant submitted that , after filing of this case the Ops have replaced the system, but have not done so earlier for which the complainant sustain case.

  4          This submission of the complainant is found to be true. There is no evidence available on record to show that the OPs have provided defect free solar system.

   5          With these submission and material available on record, it is concluded that, at present there is no issues between the parties and the complainant is entitled to compensation for harassment and is also entitled to extended warranty.   Hence Ordered:-

              The OPs are directed to extend warranty for a period of 5 years to the replaced solar home light system of the complainant. The OPs are further directed to pay Rs 5000/- ( Five thousand) to the complainant within one month from the date of receipt of this order, failing  which the amount shall carry an interest @ 9% P.A. till payment.

              Accordingly the case is disposed of,
