Vinod Kumar Thakur filed a consumer case on 19 Jan 2018 against Puma Realtors Pvt. Ltd. in the StateCommission Consumer Court. The case no is CC/519/2017 and the judgment uploaded on 25 Jan 2018.
At the time of arguments, a serious objection was raised by Sh. Rohit Tanwar, AGM (Legal) of the Opposite Party that to calculate pecuniary jurisdiction of this Commission, when we look into the total price of the unit, in question, and the relief claimed, the total amount will exceed Rs.1 Crore.
We have seen the record. The complainant purchased the unit, in question, in July, 2012. Now he is seeking refund of the amount paid alongwith interest @18% p.a. per annum, compensation, rent paid and interest paid to the Bank etc. If that is so, the complaint entertained at the initial stage was not proper.
Faced with this situation, Sh. Rachit Kaushal, Advocate, Counsel for the complainant wishes to withdraw this complaint with liberty to file a-fresh after giving better particulars. To the prayer made, no objection has been raised by the Counsel opposite.
Liberty granted.
The complaint is dismissed as withdrawn.
Spare copy be retained for the office record and all the three original paper-books (excluding zimini orders) be returned to the Counsel for the complainant.
Certified copies of the order be sent to the parties free of charge.
