ORDER | CC No.124/15 Avtar Singh Vs. The Estate Officer, PUDA Present: Counsel for the complainant. - The complainant has filed the present complaint on the ground that he purchased plot bearing No.49, Canal Colony, Near D.C.Office, Amritsar measuring 500 square yards from the Opposite Parties in open auction held on 3.3.2014 at Bachat Bhawan, Ranjit Avenue, Amritsar. Resultantly, the allotment letter dated 8.7.2014 was issued to the complainant. The total price of the plot in question is Rs.1,83,00,000/- and the complainant made payment of first installment of Rs.45,75,000/- i.e. 25% of the total price of the plot and the balance amount i.e.the balance payment of 75% is to be paid by the complainant/ allottees as per clause 3.2 of the aforesaid allotment letter. Through the present complaint, the complainant has requested that Opposite Parties be directed to provide the basic facilities/ amenities i.e. making roads, giving water supply, developed parks, etc. and the Opposite Parties be directed to pay the interest on the payment already made by the complainant and the complainant be allowed to make entire balance payment of Rs.1,37,25,000/- in one installment in lump-sum with the condition to give atleast 60 days time to deposit the same with Opposite Parties after delivery of physical possession of the plot in question after completion of the development work.
- We have heard the ld.counsel for the complainant and have minutely gone through the complaint.
- Admittedly, the subject matter in dispute in the present complaint is plot measuring 500 square yards, price of which is Rs.1,83,00,000/- and the complainant already paid Rs. 45,75,000/- as first installment to the Opposite Parties and prayed for directing the Opposite Parties to allow the complainant to make the payment of entire balance amount of Rs.1,37,25,000/- in one installment and also directing the Opposite Parties to give atleast 60 days time to deposit the same with Opposite Parties and that too after delivery of physical possession of the plot in question after completion of the development work. Thereby, the complainant, through this complaint also impliedly requested for the possession of the plot in question and allowing the complainant to make the payment of entire amount of Rs.1,37,25,000/- after 60 days from the date of possession of the plot with all facilities/ development work. So, the subject matter in dispute is the plot, its possession and payment of balance amount and requested for allowing 60 days time after giving the possession of the plot in question to the complainant to make the payment of the entire balance amount. The value of the plot in question is Rs.1,83,00,000/- which is beyond the pecuniary jurisdiction of this Forum.
- Resultantly, we hold that this Forum has no pecuniary jurisdiction to try and decide the present complaint. As such, the complaint is ordered to be returned to the complainant with liberty to file the same before the appropriate authority having competent pecuniary jurisdiction. Copy of the order be furnished to the complainant free of costs. File is ordered to be consigned to the record room.
