ORDER

The Complainants have made all these 5 Complaints seeking direction to the respective OPs to furnish information sought by them under the Right to Information Act and also sought compensation of Rs.10,000/- making certain allegation in each cases.
2. These 5 cases are clubbed for passing the Order since the facts involved in all these cases are one and the same. Therefore, these Complaints are clubbed and common order is passed.
3. The points that arise for consideration are:
(A) Whether the Complainants are consumers ?
(B) What Order ?
4. Our answers are:
(A) Negative
(B) As per detailed order for the following reasons
REASONS
On perusal of the Complaint, Complainant is seeking relief against the respective Ops on the ground that they have failed to submit the information sought for, under the Right to Information Act. Here the Complainant is only an Applicant and not a consumer as held by our Hon’ble State Commission and Hon’ble National Commission in recent cases. In view of the above, Complainant is at liberty to move the Authorities under the RTI Act in Appeal or sue the Ops for damages in Civil Court. That liberty is reserved. In view of the above, we pass the following order:
ORDER
1. Complaint is dismissed. No costs.
2. Return extra sets to the parties concerned under the Regulation 20(3) of the Consumer Protection Regulations 2005.
3. Send copy of the Order to the parties concerned free of cost.
4. Original Order shall be kept in Complaint No. 12/2012 and the copies thereof in Complaint Nos. 13 to 16/2012.
5. Dictated to the Stenographer, got it transcribed and corrected and pronounced in the open Forum on this the 20th day of March 2012.
