Order No.   17    Dated  26/09/2012.

            The petition of complaint has been filed by the complainant…….. against the o.ps. …. In the instant case the complainant interalia stated that he has approached before o.p. in connection with furnishing of information under R.T.I. Act, 2005, after deposition of requisite fees as has been prescribed in the said Act. The complainant further stated that the o.p. failed to supply the information as has been asked for by the complainant under the R.T.I. Act, 2005.

            For the facts as stated above the complainant filed the instant case before this Forum with some prayer as has been stated in the petition of complaint. The o.p. appeared in the case by filing w/v and interalia stated that the complainant is not a consumer to them and the complainant has no cause of action for lodging this case and prayed for dismissal of the case.

Decision with reasons:-

            Upon perusal of the entire materials on record and having heard by both sides we are of opinion that this Forum is not competent to adjudicate the mater in respect of refusal and/or right to furnish any information under the R.T.I. Act, 2005 since the provision of Appellate Authority has been provided in the said Act and the complainant failed to agitate the matter before the competent Appellate Authority for obtaining relief.

            Hence, ordered,

            That the instant complaint case is dismissed on contest without cost since the instant Forum has no jurisdiction to adjudicate the matter. The complainant is at liberty to agitate the issue before th e appropriate authority on the self same cause of action.

            Supply certified copy of this order to the parties free of cost.
