Complainant has filed the present complaint against OPs for illegally disconnecting his electric connection bearing a/c no.F46KL530114P and new F46KL531493H without any prior intimation or notice. The brief facts of the case are that earlier, connection in dispute was in the name of one Hazara Singh, who was the grandfather of complainant and after his death, the said connection is being used by the complainant and he got it transferred in his name after depositing requisite fees on 10.10.2013 and he is regularly paying all the electricity bills and nothing is due towards him. The OPs issued him last bill dt 5.10.2015 for 6,010/-which is deposited by him on 20.10.2015. Copy of bill and receipt is Ex C-2 and C-3. On 17.11.2015, when he was not present in his house, the employees of OPs disconnected his electric connection without any prior intimation or notice. The wife of complainant requested employees of OPs not to disconnect his connection and also showed receipt regarding deposit of bills but they did not hear her genuine request. Complainant approached Ops to enquire about the reason for disconnection of his electricity connection but officials of OPs told him that an amount of Rs 50,000/-is due towards him. The complainant showed all the receipts regarding deposit of amount and requested them for restoring his connection, but they refused to do so and did not listen his genuine request. The Ops have no right to disconnect his connection without any intimation or notice without any reason as nothing is due towards him pertaining to his dues. All these acts of OPs amount to deficiency in service and trade mal practice on their part. He has prayed that his electric connection may be restored and also prayed for compensation and litigation expenses.

2                                    Upon notice, the OPs appeared in this Forum and filed their written reply. They pleaded that OPs never disconnected the electric connection of complainant and the connection in dispute is still working at the spot and complainant is using the same. Even after filing of present complaint, the Meter Reader of the OPs took consumption reading of the meter of complainant and a bill for the same is also sent to complainant for a sum of Rs 4,330/-and due date for deposit of bill was 23.12.2015. Connection in dispute is still working and is connected at the premises of complainant. OPs never demanded Rs 50,000/-from complainant as due and recoverable from the complainant regarding his electric connection. Complainant never approached OPs and his connection is still working and was never disconnected by Ops. Complainant has filed this present complaint on false and frivolous grounds to harass the Ops with malafide intention as they have never disconnected his connection and never demanded any amount of Rs 50,000/- from him. As such, there is no deficiency in service or trade mal practice on the part of OPs and complaint may be dismissed with costs.

3                   The case of the complainant is that he has an electric connection and he is paying regularly all the bills but Ops illegally disconnected his electric connection and demanded Rs 50,000/-from him for restoring his connection. OPs submitted that they never disconnected his connection and his said electric connection is still working and complainant is using it at his premises and they never demanded any amount of Rs 50,000/-from him regarding connection in dispute.

4                        In these circumstances, where Ops submitted that they never disconnected the electric connection in dispute and never demanded any amount from complainant, the present complaint becomes infructuous and therefore, present complaint is dismissed being devoid of any merits. However, the OPs are directed to not to disconnect the electric connection of complainant without any prior notice or information to complainant and also to give proper opportunity to hear him. Copy of the order be supplied to parties free of cost as per law. File be consigned to record room.
