Sh. Dev Singh complainant has filed this complaint under Section 12 of the Consumer Protection Act,1986 ( hereinafter referred to as the Act) against the Opposite Parties (hereinafter referred to as the O.Ps.). The brief facts of the complaint are as under:

The ld.counsel for the OPs has tendered in evidence Er.Sachin Kumar,SDO alongwith documents Exs.OP1 & OP2 evidence.

“ for release of tubewell connection under general or Priority Categories minimum land holding of one acre shall be pre-requisite.” From the declaration letter dated 22.1.2013, Ex.OP1, it is evident that complainanthad declared that he is the owner of 2.5 bighas of land. Since the complainant is having less than one acre of land therefore, he is not entitled to get the electric connection for tubewell under the said scheme. It may be stated here that once the complainant wasnot entitled to get the electric connection for tubewell under the said scheme, then by getting deposited the amountof Rs.71703/-from the complainant, the Ops have committed deficiency in service and are thus liable to refund the total amount got deposited from the complainant i.e. Rs.71703/- + Rs.2000/-alongwith interest from the respective dates of deposits. They are also liable to compensate the complainant for the mental agonyand physical harassment suffered by the complainant alongwith litigation expenses.

- To refund the security amount of Rs.2000/- and an amount of Rs.71,703/- alongwith interest @7% per annum from the respective dates of deposit till realization;.
- To pay Rs.10,000/- as compensation on account of mental agony and physical harassment caused to the complainant;
- To pay Rs.5000/- as litigation expenses.
The Ops are further directed to comply the order within a period of 30 days from the date of the receipt of the certified copy of this order. Certified copies of this order be sent to the parties free of cost under the Rules.Thereafter, file be indexed and consigned to the Record Room.
