Opposite parties filed written version in which they stated that meter of the complainant was checked by the JE of the opposite party namely Sh.Nirmal Singh on 7.9.2015 and found that meter of the complainant was missing from the box and the complainant has been consuming the electricity by attaching direct wires thereby by bye passing the meter. Resultantly, it was found a case of theft of energy. Opposite party has produced on record copy of the said report dated 7.9.2015, copy of ledger, photographs and complaint letter written by the opposite party bearing No.1680 dated 10.9.2015 to the SHO, Anti Power Theft Police Station, Amritsar regarding registration of a case against the complainant. Opposite party also produced on record copy of the notice u/s 135 of the Electricity Act bearing No.1679 dated 10.9.2015. All this shows that present case is a case of theft of energy.
In view of the judgement of the Hon’ble Supreme Court of India in case titled as U.P.Power Corporation Ltd. & others Versus Anis Ahmed in Civil Appeal No.5466 of 2012 decided on 1.7.2013, this Forum has no jurisdiction to try and decide present complaint being a case of theft of energy. So, complaint is returned to the complainant with liberty to file the same in the appropriate court having jurisdiction. Copy of the orders be furnished to the parties free of costs. Papers are ordered to be consigned to the record room.
