Sh.Anil Sharma,Adv.counsel for the opposite party has got recorded his statement that present case relates to theft of electricity as per information received from the opposite party. He has also produced copy of the checking report dated 7.8.2014 and memo No.1249 dt. 12.8.2014 in this regard. A perusal of the checking report dated 7.8.2014 and memo No.1249 dt.12.8.2014 proves this fact. As such,in view of the judgement of the Hon’ble Supreme Court of India in case titled as U.P.Power Corporation Ltd. & others Versus Anis Ahmed in Civil Appeal No.5466 of 2012 decided on 1.7.2013, this Forum has no jurisdiction to try and decide present complaint being case of theft of energy. So, complaint is returned to the complainant with liberty to file the same in the appropriate court having jurisdiction. Papers are ordered to be consigned to the record room.
