                   Perused. As per the application filed by the Opposite Parties for the dismissal  of the complaint and checking report of SDO of the Opposite Parties  dated 16.7.2014 placed on record by the Opposite Parties, the present complaint case filed by the complainant is a case of theft of electricity as the complainant  was found consuming electricity directly from the main lines by bye-passing his meter. So, the present case is a case of  theft of electricity.  

In view of the judgment of  Hon’ble Supreme Court in case U.P. Power Corporation Limited & Ors. Vs Anis Ahmad Civil Appeal No.5466 of 2012 decided on 1.7.2013, this Forum has no jurisdiction to try and decide the present complaint because the present case relates to theft of  electricity, as such, is not maintainable in the Consumer Forum. Resultantly, the  complaint is returned to the complainant with liberty to file the same before the appropriate court/ Forum having jurisdiction. Copies of this order be supplied to the parties free of cost. File be ordered to be consigned to the record room.
