Present complaint has been filed by Sh.Jaskaran Singh under the provisions of Consumer Protection Act alleging therein that the complainant applied a new electricity connection which was released by the opposite party and the complainant is now having an electricity connection vide account No.SW46/399 and same is being used by the complainant. The complainant was having dispute with the brother Lakhbir Singh regarding the property and the said Lakhbir Singh is an influential person and moved

application to the opposite party to disconnect the electricity connection. It was further alleged that officials of the opposite party visited the premises of the complainant and are threatening the complainant to disconnect the electricity connection which was ever earlier issued by the opposite party after completing all the formalities. So, feeling aggrieved, the complainant filed the present complaint for directions to the opposite party not to disconnect the electricity connection.
2 On notice, opposite party appeared and filed written version in which it was admitted that Lakhbir Singh brother of the complainant moved application to the opposite party to disconnect the electricity connection of the complainant issued by the opposite party, but the opposite party never tried to disconnect the electric connection of the complainant. So, there is no deficiency in service on the part of the opposite party.
3 Complainant tendered his duly sworn affidavit ex.C-1, copy the payment receipt ex.C-2, service connection order ex.C-3.
4 Opposite party tendered affidavit of Sh.Tejinder Pal Singh, AEE ex.OP1.
5 We have carefully gone through the pleadings of the parties, arguments advanced by the counsel for the parties and have appreciated the evidence produced on record by both the parties with the valuable assistance of the ld.counsel for both the parties.
6 From the record i.e.pleadings of the parties and the evidence produced on record by both the parties, it stands proved on record that the complainant was released electricity connection bearing Account No. SW46/399 which he has been using. His brother Lakhbir Singh had given application to the opposite party for disconnection of electric connection of the complainant. Opposite party has submitted that no doubt, Lakhbir Singh

brother of the complainant moved application to the opposite party to disconnect the electricity connection of the complainant issued by the opposite party, but the opposite party never tried to disconnect the electric connection of the complainant. Resultantly, this complaint has become infructuous and same is hereby dismissed with no order as to costs. Copies of the order be furnished to the parties free of costs. File is ordered to be consigned to the record room.
