ORDER

Present complaint under Section 12 of the consumer Protection Act, 1986 as amended upto date has been filed by complainant Sadhu Singh against opposite party PSEB and its other functionaries. 2. Brief facts of the complaint are that complainant is having electric connection bearing A/c No. X12CH530665N with the sanctioned load of 0.40 KW. It is further alleged that he is poor rickshaw puller and belongs to Scheduled caste category and from the year 2005 there is concession of electricity to the scheduled caste persons. Opposite party PSEB sent a bill of Rs.5074/- in the month of 7/2008 which was deposited by him under fear of disconnection. Then again he received bill of Rs. 4470/- in the month of 11/2008 from the opposite party PSEB. He approached opposite parties and requested them to withdraw the said bill as the same is illegal, null and void. This amounts to deficiency in service on the part of opposite parties against which he is entitled to relief. 3. In this case summons were issued to opposite parties for 21/1/2009 and on 21/1/2009 opposite parties appeared before us through counsel. Today counsel for opposite party has filed written statement and in the written statement, opposite party PSEB has clearly acceptd that opposite party is giving concession of 400 units per bill to all scheduled caste consumers as per policy of the Govt. adopted by the PSEB. If bill of scheduled caste consumer is more than 400 units then he is liable to pay for excess units consumed beyond 400 units. In the bill issued on Sept.2008 complainant consumed 1185 units and after giving him concession of 400 units, bill was sent to the consumer for remaining units. This bill was prepared for Rs.3560/- plus surcharge of Rs.317/-. Complainant did not pay the bill, so the amount was rightly added in the bill of next month and this bill is increasing by passage of every month and in the month of Dec.2008, Rs.4523/- is shown as payable amount and in the month of Dec.2008 number of units consumed from 26/10/2008 to 26/12/2008 is shown to be 274 units and no bill is being charged for consumption of these 274 units. However, opposite party PSEB is sending bill to the complainant only for remaining amount which is shown as Rs.4470/- in the bill issued in Dec.2008. Detailed statement of counsel for opposite parties PSEB recorded. From the perusal of written statement it is clear opposite party PSEB is not charging any amount for consumption of 400 units per bill. Complainant alleged that he is poor man and rickshaw puller , so we direct opposite party PSEB to charge outstanding bill of Rs. 4470/- in four equal instalments without surcharge in addition to the regular bill if any. Let certified copies of judgment rendered be supplied/despatched to the parties without any unnecessary delay and thereafter file be consigned to record room.
