of the dispute-The petitioner availing of the remedy-<br /> The petitioner cannot approach the Forum complaining <br /> deficiency in service-District Forum is not an <br /> appellate authority over the respondent-Electricity Board-<br /> Complainant held not entitled to get any interest on <br /> amount settled by the respondent-Electricity Board-<br /> Petition dismissed."<br /> XX XX XX<br /> In the recent case reference may also be made to case of Hon'ble State Commission reported as 2005 (3) CLT 491 and latest case reported as 2007 CTJ 1074 wherein it was held that once consumer exhausted remedy under Section 42 of the Electricity Act, 2003 and Electricity ombudsman, he stands debarred from knocking the door of Consumer Forum established under Consumer Protection Act,1986 and also held that Section 3 of the Consumer Protection Act, 1986 does not envisage multiplicity of litigation and does not permit consumer Forums to encourage Forum hopping just because of existence of that Section.<br /> In the ultimate analysis of aforesaid discussion, complaint having no merit is liable to be dismissed and same is hereby dismissed with no order as to costs.<br /> Let certified copies of judgment rendered be supplied/despatched to the parties without any unnecessaryt delay and thereafter file be consigned to the record room.<br /> <br /> Announced : ( Surinder Mittal ) ( A.K.
