loads of 50 KWs and above and <br /> all other categories of consumers including<br /> agricultural pump sets (meter supply) bills will<br /> be issued monthly.<br /> If the complainant consumes no energy or less energy than stipulated units i.e. eight hours per night on the connected/sanctioned load then the complainant is liable to pay on the basis of average eight hours per night and if consumer consumes more electric energy than stipulated units on the basis of eight hours per night then he will be liable to pay charges as per actual consumption of units. The bills under dispute supplied to the complainant by the opposite parties have been prepared as per connected/sanctioned load on the basis of taking load X eight hours per night X No. of days during the month .. Equally the letter dated 25/10/2005 Ex.C26 of the Director Local Self Government Punjab misinterpreted annual minimum charges clause 89.6 of the Sales Regulation and judgment referred to therein and also the order of District Consumer Forum, Amritsar because in that case, unilateral inspection was carried out by the officers of Electricity Board on checking when direct supply without recording in the meter was detected and only a few points were connected with meters in case decided by the District Consumer Forum, Amritsar. Consequently the PSEB levelled the penalty charges for the consumption of the increased units than the sanctioned loan. However, in the instant case the opposite parties have claimed the charges on the basis of stipulated units i.e. eight hours per night on the connected load and not on the basis of actual units consumed which is perfectly and legally justified as per the parameter laid down in 89.6 ( annual minimum charges) of Sales Regulation and under the present circumstances it is an obligatory on the part of opposite party No.2 to supply the bills for the calender year 2006, 2007 and for the year 2008 on the basis of average of eight hours per night on connected/sanctioned load whichever is higher for the whole year and is liberty to charge for the difference between the stipulated units and units actually consumed at tariff rates..<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> In the ultimate analysis of aforesaid discussion ,We are of the considered opinion that the energy bills issued by the opposite parties to the complainant for the period w.e.f.January,2006 to December 2006 , March 2007 to December 2007 and for the period March,2008 are legal and valid as such the complainant is not entitled to have any claim of refund from the opposite parties .Hence, the complaint is dismissed with no order as to costs . Copy of the judgment be sent to the parties free of costs through registered post without any delay.
