7. We have considered rival contentions of counsel for the parties. We find merit in the contentions of learned counsel for the complainant.. The perusal of earlier bills Ex.C1 to C3 from March, 2007 to July, 2007 indicates status of the meter okay and the consumption of the electricity was shown. Secondly there is no basis to levy electricity charges on average basis on the assumption that premises were locked at the time of reading of the meter in the month of Sept.2007 because column is left blank in the bill Ex.C4 and in the other bill Ex.C5, status of the meter was shown as "D". We find basis of average consumption is wrongly placed on these two bills and inspection note dated 3/6/08 Ex.R4 alongwith ledger book and consumption data Ex.R5. Admittedly meter was changed on 10/1/08 vide MCO No. 90/42577 whereas Regulation No.71.1.1 of the Sales Regulations mandates that : <br /> ""Whenever complaint regarding faulty behaviour of the energy<br /> ts received. Meter Inspector or JE should be asked to visit the premises and test meter of the site with the help of stop watch. If, on testing complaint of the consumer is found to be correct, meter should he immediately replaced. If however any loss thereof is suspected, the dismantled meter should be got tested from the Lab and Account of the consumer be overhauled on the basis of result intimated by the XEN/ME. Full details of extra amount assessed to consumer should be intimated to him as a separate bill. If accuracy of the meter is doubted, the same shall he tested in the ME Lab after payment of necessary charges as per Regulation No.71.2.1."<br /> Further Regulation No. 71.2.2 mandates that<br /> "Meter should he sent to ME Lab within fifteen days from its removal, promptly tested and result should he intimated to AE/AEE/XEN in seven days from the receipt of the meter and then it be intimated<br /> immediately to consumer and after getting his acceptance adjust account accordingly. The whole process should in no case take more than a month."<br /> 8. Therefore, we find gross violation of above rules by the opposite party in conducting checking of the meter alleged to be defective and imposing consumption charges on average basis arbitrarily. Moreso; there is violation of principle of natural justice as complainant was not apprised about status of the meter. <br /> In the ultimate analysis of aforesaid discussion we accept the complaint and quash impunged bills Ex.C4 and C5 with direction to refund the amount of these two bills with further monetary compensation of Rs.2000/- for mental agony and physical sufferings on account of deficiency in service and Rs.1000/- as cost of litigation within mone month from the receipt of copy of this order.<br /> Let certified copies of judgment rendered be supplied/despatched to the parties without any unnecessary delay and thereafter file be consigned to record room.<br /> <br /> Announced : ( Surinder Mittal ) ( A.K.
