" Any person who buys or avails of any services<br /> for consideration which has been paid or promised<br /> or partly paid or partly promised or under any <br /> system of deferred payment and includes any <br /> beneficiary other than the person who hires <br /> or avails of such services partly paid <br /> and partly promised."<br /> Moreover, there is specific avernment in para 1 of the complaint and in the affidavit Ex.C1 that his father Jagir Singh was the consumer and after his death vide death certificate Ex.C2, he being the legal heir is the beneficiary of the electric energy for consideration with the implied approval of his father deceased fall under the definition of "complainant" and also "consumer" of Electricity Board as he has been paying the electricity bills duly accepted by the Electricity Authorities. No doubt much emphasis has been laid upon clause 39.2.1 of Conditions of Supply by learned counsel for the opposite parties that " in the event of non -renewal of agreement by the heirs after death of consumer , Electricity Board is empowered to disconnect the the connection after six months of death of consumer . Since complainant being legal heir of the deceased consumer of electric energy is also included within the ambit of "Consumer"<br /> In the ultimate analysis of aforesaid discussion, we quah the impunged bill Ex.C1 to the extent of sundry charges amounting to Rs.17,175/- and further direct the oppoite parties to refund the amount of Rs.6200/- deposited by the complainant in compliance of interim order dated 3/9/07 passed by this Forum with interest @ 9% p.a. from the date of deposit till realisation. Complainant is further awarded monetary compensation of Rs.2000/- on account of mental agony and physical harassment which is to be recovered from the delinquent officials for their gross failure to comply with the instructions of PSEB itself. Complainant is further entitled to cost of litigation of Rs.500/-. The above directions be complied with by the opposite parties within a period of one month from the receipt of copy of this order.<br /> Let certified copies of judgment rendered be supplied/despatched to the parties without any unnecessary delay and thereafter file be consigned to record room.<br /> <br /> Announced : ( Surinder Mittal ) ( A.K.
