Case posted today for hearing on admission of the Complaint.
Complainant present through his advocate and argued on the point of admission.
Heard argument, perused the complaint petition and document filed by the Complainant and found from the complaint petition and documents of the Complainant, the transactions made between the Complainant and O.Ps are purely commercial transaction no where it is revealed from the complaint petition as to livelihood of the Complainant is affected due to the deficiency caused by the O.Ps to the complaint.
More over the O.P.No.1(one) and O.P.No.2(two) are having their offices beyond the jurisdiction of this Court. The Complainant has also not brought before any evidence as to the O.Ps that they are working under the jurisdiction of this forum for their gain.
So in both the points of view neither the Complainant is a Consumer of the O.Ps nor the Complaint filed is beyond the jurisdiction of this forum as per provision of C.P.Act 1986. Hence the Complaint filed by the Complainant is not entitled for admission, it is rejected.
