Shri S.L. Behera, President : -  The complaint case in brief is that the complainant has purchased one Maruti Wagon R VXI Car bearing Regn. No. OD-23B-3399 from the O.P.No.1 through O.P.No.3 on dtd. 15.10.2014. After purchasing the complainant insured his said vehicle before O.P.No.2 under O.P.No.1 and O.P.No.2 issued policy document to the complainant which was valid upto 04.10.2015.  On 30.09.2015 the complainant handed over a copy of RC Book and previous policy along with a cheque of Rs.10,263/- only bearing cheque No. 379613 of Syndicate Bank to the O.P.No.2 towards renual premium of insurance of his said vehicle.  The O.P.No.2 encased the said cheque in his favour but did not issue further insurance policy to the complainant.  The complainant enquired several times from the O.Ps but did not get any result and due to which he is not able to ply the vehicle, hence this case.  

            The O.P.No.1 appeared after being noticed filed written version. The O.P.No.1 submitted that though the complainant handed over the relevant documents along with cheque for renewal of premium but the insurance Agent namely Asis Kumar left the job due to which the documents could not be delivered to the complainant but the O.P.No.1 through the O.P.No.2 and O.P.No.3 send the documents along with insurance policy to the complainant on dtd. 23.05.2016 with registered A.D and denied all the allegations.

 

            Heard from the parties and gone through the case record. The complainant. Filed a copy of insurance policy in favour of the complainant bearing policy No. 35101031156137323761 which is valid from 06.10.2015 to 05.10.2016 having vehicle Regn. No. OR-23B-3399.  It is worth noting that the said vehicle of the complainant is having Regn. No. OD-23B-3399 but the O.ps. have issued insurance of the vehicle bearing Regn.NO. OR-23B-3399.  The complainant has filed 04 numbers of bills of Sai Sri Travels amounting Rs.12,300/-, Rs.14,220/-, Rs.13,460/- and Rs.13,330/- only ( i.e. Rs.53,310/- in total) as he had been to various tours by hiring other vehicles due to non-plying of his vehicle. 

 

            The O.Ps. send the insurance policy document through post in much belated period and that was also issued in some other number of registration such types of activities denotes towards unfair trade practice and deficiency in service on the part of O.Ps.

 

Hence the present case is allowed with the following directions;-

 

ORDER

  1. The Opposite parties are hereby directed to make necessary correction in the  registration number of vehicle in the insurance policy document of complainant in his own cost, if any.
  2. The Opposite parties are hereby directed to pay a sum of Rs.53,310/- ( Rupees fifty three thousand three hundred ten) only to the complainant towards expenditures beared by the complainant.
  3. The Opposite parties are hereby further directed to pay a sum of Rs.10,000/-       ( Rupees ten thousand) only towards harassment and mental agony.
  4. All the aforementioned orders are to be carried out within one month from the date of receipt of this order, failing which interest @ 10% per annum will be charged on whole awarded amounts till realization from the date of order.

           

Accordingly the case is dispose of.

 

Order pronounced in the open court today on this the 28th day of September’ 2016, copy of this order shall be communicated to the parties as per Rule.
