ORDER

The complainant Sri. Muhammed Lias has filed the complaint before this Forum alleging deficiency of service on the part of the opposite party. The contention of the complainant is as follows:- The complainant is an employee of a private company at Ernakulam and in addition to, he is a real estate Agent. He has taken a Mobile Phone connection vide No.9249417480 from M/s. Tata Teleservice Ltd. and the opposite party is the registered agent of the said Tata Teleservice Ltd. The complainant has paying the bill amount regularly and without any default. On 1.12.2007 the complainant has entrusted the cheque for Rs.340/- towards his bill amount, with the opposite party for remitting the same to M/s.Tata Tele service Ltd. and the opposite party had issued the receipt No. dt. 29.11.07 to the complainant. But the opposite party had not remitted the above said amount to M/s.Tata Teleservice Ltd. in time. So the company – M/s. Tata Teleservice had disconnected the phone of the complainant with effect from 8.12.2007. The complainant had intimated the details of remittance to M/s. Tata Teleservice Ltd. through phone. On 12.12.2007 the complainant’s phone service was activated by the company. Again it was disconnected on 15.12.2007 with the cancellation of outgoing call facility. Again the complainant informed the details of remittance and requested to activate the phone service. As such the complainant has got the activated service with effect from 20.12.2007 onwards. Since the complainant has not obtained any positive relief from the opposite party regarding the above matters and for deficiency of service, the complainant 2. Notice was issued to the opposite party and it was accepted by the opposite party on 12.1.2008. But he has not entered appearance. Considering his absence the opposite party was set exparte on 25.2.2008. 3. Considering the contentions of the complainant this Forum has raised the issue whether there is any deficiency of service on the part of the opposite party. 4. Complainant has filed proof affidavit and produced document in evidence. We are perusing the complaint, proof affidavit and documents and a detailed hearing, this Forum is of the view that there is deficiency of service on the part of the opposite party in delay to send the remitted amount of Rs.340/- to M/s. Tata Teleservice Ltd. in time in order to avoid the several disconnection of Mobile phone service of the complainant. So the complaint is to be allowed. In the result we direct the opposite party to pay a sum of Rs.2000/- (Rupees two thousand only) towards the compensation for mental agony and inconvenience and a cost of Rs.1000/- (Rupees one thousand only) to the complainant. We further direct the opposite party to pay the above said amounts to the complainant within one month from the date of receipt of this order.
