By Jayasree Kallat, Member: The complainant purchased a churidar material for an amount of Rs.1080/- on 2-1-2010. After two weeks the complainant had stitched the churidar. When she wore the churidar the colours of the churidar print had become all over the body of the complainant and her child of six months old. Complainant alleges that the silver lining had completely vanished from some parts of the cloth material and the churidar lost its appealing. So the complainant had approached the opposite party on January 19th and complained about the fading of the print. Opposite party did not take any effort to redress the grievance of the complainant. Hence the complainant had filed the petition before the Forum. Notice sent to the opposite party was served. But the opposite party did not appear before the Forum. Opposite party was called absent and set exparte. The complainant was examined as PW1 and the bill was marked as Ext.A1. The churidar was produced before the Forum which was identified as M.O1. The Forum noticed the defects and returned back the churidar to the complainant. The Forum has been convinced of the defects in the material. In the result the petition is allowed and the opposite party is directed to return back Rs.1080/- to the complainant along with a cost of Rs.500/- within one month from the date of receipt of copy of the order. On paying the amount opposite party can get back the churidar material from the complainant. Pronounced in the open court this the 30th day of April 2010.
