COMPLAINT NO: 997 OF 2007 Sowbagya.C, No.7176, Near Lions Club, B.H. Main Road, Subhashnagar Extension, Nelamangala. Complainant V/S The Proprietor, H.007, Ladies Wear, No.1, 5th Main Road, Chamarajpet, Bangalore-560018. Opposite Party ORDER This complainant states that, she has purchased a saree of worth Rs.1,910/- along with blouse from Lakshmi Sarees, Bangalore. She has produced receipt for having purchase the saree. She states that, she has given the blouse for stitching with the opposite party under bill No.9314 and she has paid Rs.150/- as stitching charge in advance. She sent a letter on 3/1/2007 by registered post requesting to deliver the blouse or to pay Rs.150/-. In spite of her demand the opposite party has not given the blouse. Therefore, she has filed this complaint for recovery of Rs.150/- plus Rs.10,000/- as compensation for mental agony. 2. Notice was issued to opposite party and he has filed defense version stating that he is rendering a very good service to the customers and he has denied that he has not given back the blouse to the complainant. Hence, he has requested to dismiss the complaint. 3. Arguments are heard. 4. The point for consideration is:- Whether the opposite party can be directed to refund Rs.150/- stitching charge and the price of blouse cloth? REASONS 5. It is an admitted case of the parties that, the complainant was the customer of the opposite party. The opposite party is said to be a famous Tailor of Bangalore for ladies outfit. The opposite party produced a certificate of commendation from the then Governor of Karnataka Smt. V.S. Ramadevi. The advocate for the opposite party argued that the opposite party being reputed tailor of Bangalore he is ready to refund Rs.150/- and also pay the cost of the blouse cloth to the complainant without taking any unnecessary dispute or litigation. The husband of the complainant was also present at the time of hearing of the matter and he has also fairly and rightly ready to accept the refund of the stitching charge paid by his wife plus the cost of the cloth. So, in this way the matter has been settled in a very cordial and harmonious way. We have to appreciate the spirit of compromise and settlement. Though this is a small matter but the complainant has asserted her right by coming to the Forum. The purpose of enactment of Consumer Protection Act is to provide better service and to protect the interest of the consumers. Therefore, the courage of the complainant also to be appreciated in coming to the Forum for getting the relief. In the result, we proceed to pass the following:- ORDER 6. The complaint is allowed. The opposite party is directed to refund Rs. 150/- the stitching charge of the blouse plus Rs.200/- the cost of the blouse cloth. 7. The opposite party is also directed to pay Rs.300/- towards litigation costs. 8. In this way the total amount that could be payable by the opposite party to the complainant is Rs.650/-. 8.
