The petitioner purchased a ‘Skil 3 MM drill’ which cost him Rs.2000/- from the shop of the opposite party on 25.6.2007. Its armature has burnt off after some days. The petitioner complained against it twice. Even if in each time it was subjected to repair, the opposite party could not mend its complaint properly. Later, when the armature thus has been burnt thrice, the petitioner contacted him again and wanted him for another one of same kind. But the opposite party has not shown any willingness to do so. Notice sent, no reply, no remedy. Hence this complaint.<br /> <br /> 2. Respondent has accepted the notice from the Forum, but remained absent and set exparte. <br /> <br /> 3. To prove the case, the petitioner has filed affidavit and four documents. The documents are marked as Exts. P1 to P4. There is no counter evidence.<br /> <br /> 4. So the petition is allowed and the respondent is directed to pay to the petitioner Rs.2000/- (Rupees two thousand only) as the cost of the product; Rs.1000/- (Rupees one thousand only) as compensation and Rs.500/- (Rupees five hundred only) towards cost.
