1.           This complaint is filed under section 35 of Consumer Protection Act 2019 and stood over to this date for consideration and this Commission passed the following order.

2.           This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. After accepting the notice, both the parties failed to appear before this commission and hence on 21/04/2022, the opposite parties 1 & 2 were declared exparte. As the complainant was continuously absent, this commission issued a notice to the complainant to appear before this commission to further proceed with this complaint. The said notice issued to the complainant was returned with endorsement “addressee expired’’. To ascertain whether the legal heirs of the deceased complainant are interested to further proceed with this complaint, the case was once again adjourned to this date. When the case came up for consideration today, no legal heirs of the original deceased complainant approached this Commission to implead themselves in this proceedings and hence we find that legal heirs of deceased original complainant is not interested to further proceed with this complaint.

              In the result, compliant is dismissed for default. There will be no order as to costs. 

              A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
