                                                                                                 O R D E R

                                                The case of the Complainant in short is that he is not getting his Gas from the O.P regularly even if after repeated request. So, he compelled to purchase the Gas cylinder from the open market by paying extra amount in the year 2017. He has purchased five Gas cylinders from the market .On 06-10-2017 he booked for a gas for home delivery but he has not received the Gas till the filing of the case it is on 03-11-2017 in spite of repeated request. Being a senior citizen he  is suffering due to negligence of the O.P and filed this case to get relief. 

                                                The O.P was set exparte in spite of getting notice from this Forum on 15-12-2017 as reveals from the Peon Book.

                                                We have heard the Complainant. We have gone through the complaint petition and the documents filed by the Complainant in support of his case. As per rule the Complainant is entitled to get one Gas cylinder for each and every month and the O.P should deliver the same Gas within 7 days from the date of booking at the house of the Complainant. The Complainant is a bonafide consumer and the negligence of the O.P amounts to deficiency in service on his part. Hence, the Complaint filed by the Complainant is allowed exparte against the O.P.

                                                The O.P is directed to deliver the Gas at the house of the Complainant within 7 days of his booking henceforth. The O.P is further directed to pay Rs. 1,000/- to the Complainant towards his loss and mental agony. In case of failure the Complainant shall be liable to get 10% annual interest on the awarded amount from the date of filing of this Complaint it is on 03-11-2017 till the date of realization.

                                                The C.C is disposed of. Supply free copies of this order to both the parties.
