            The facts of the complaint in brief are as follows:

            That the complainant purchased a bicycle on 06-12-2013 as   a birthday gif to her grandson for an amount of Rs.1500/-.  But the bicycle cannot be used since it was not moved.  Then the same was informed to the opposite party and he was convinced the defect and told that it is  due to the defect of one screw and  the screw is not in stock he will give the screw later.  Next day the complainant gone to the opposite party’s shop and kept the bicycle there for changing the screw.  On 1-1-2014 she had gone to the opposite party’s shop for taking back the bicycle then  the opposite party is not ready to give  the bicycle.  Hence this complaint is filed for necessary relief.

2.         On admission of the complaint on file the Forum issued  notice  to opposite party. Notice to opposite party returned unserved with an endorsement ’refused’.  Name of opposite party called and he remained absent, set exparte.

3.         Complainant is examined as PW1 and Ext.A1 marked.  Heard the complainant and documents perused.

            Upon hearing the complainant and on perusal of document and facts and circumstances of the case we are of the opinion that the opposite party failed to provide after sale service to its customers. Denial  of after sale service to customer amounts to deficiency in service. Therefore the complaint is allowed, directing the opposite party to refund Rs.1500/-being the price of the bicycle and pay Rs.3000/- for compensation and Rs.2000/- as cost of the proceedings. Time for compliance is 30 days from the date of receipt of copy of order.
