The petitioner had given Rs.1,00,000/- by three instalments to the respondent to get admission for MBA course in SRM College, affiliated to Madras University. The respondent assured to do the whole things for getting admission there. But the respondent do nothing to get admission. The petitioner approached the respondent several times. But there was no response. Lawyer notice sent, no reply, no remedy. Hence the complaint. 2. The notice sent from the Forum is refused as addressee left, not known. On 7.1.08 the respondent is called absent and set exparte. 3. To prove the case of the petitioner, the petitioner has filed an affidavit and the documents produced by him were marked as Exts. P1 series and P2. 4. Heard the counsel. 5. According to the petitioner, he is entitled to get back the amount he had remitted, ie. Rs.1,00,000/- with 12% interest. He also claims compensation and costs. There is no counter evidence. 6. So the petition is allowed and the respondent is directed to return the amount of Rs.1,00,000/- (Rupees one lakh only) with interest at the rate of 12% per annum from 25.5.07 and 6% interest from today till realization. He is also entitled for cost of Rs.500/- (Rupees five hundred only). Comply the order within one month.
