Today is fixed for ex-parte hearing and hearing the petition dated 18/01/2024 filed by the O.P. Complainant in person is present. Ld. Advocate for the O.P is present.
Petition dated 18/01/2024 filed by the O.P is taken up for hearing. Same is registered as M.A. 144/2024. Said petition is taken up for hearing. Heard both sides. Perused the petition. O.P by filing the said petition prayed for vacating the order of ex-parte hearing of this case.
During hearing Ld. Advocate for the O.P submits that he filed the W/V after 45 days and for the ends of justice liberty be given to him to contest the case. He also prayed for acceptance of the W/V.
On perusal of record we find that notice served upon the O.P on 25/08/2023 and O.P filed the W/V on 13/10/2023. Accordingly we find that O.P filed W/V after expiry of statutory period.
Accordingly we find that W/V filed by the O.P is not acceptable.
Considering the entire matter prayer for vacating the ex-parte order, filed by the O.P is considered and rejected.
Case shall run ex-parte against the O.P.
M.A. 144/2024 is thus disposed off.
