Padmini Sudheesh, President<br /> <br /> The case of the complainant is that his Montego Rover Car having Regn.No.KL8/L 6990 met with an accident on 14/5/05 and the vehicle was taken to the workshop of the respondent for repair. At that time there was no defect to the front glass of the vehicle. On December 2005 the vehicle was returned after repair and it was noticed a crack on the front glass. The respondent told that it was occurred during repair and ready to replace another one. But it was not done. Rs.16,000/- will cost for the rectification. Lawyer notice addressed on 6/6/06. Reply was sent by the respondent. But no remedy so far. Hence this complaint.<br /> <br /> 2. Respondent declared exparte.<br /> <br /> 3. To prove the case petitioner has filed affidavit and three documents which are marked as Exhibits P1 to P3. There is no evidence to the contrary.<br /> <br /> 4. According to the complainant he is entitled for Rs.16,000/- for replacing the cracked glass and cost and compensation.<br /> <br /> 5. In the result the complaint is allowed and the respondent is directed to give Rs.16,000/- (Rupees Sixteen thousand only) and Rs.2000/- (Rupees Two thousand only) towards cost and compensation.
