This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. The 1st opposite party entered appearance and filed written version denying the allegation raised by the complainant. When the case was considered on 02/03/2023 for taking steps against the 2nd opposite party, 1st opposite party and complainant were present and submitted that there is a chance of settlement and the matter may be referred to mediation. Accordingly the matter was referred to mediation to be held on today i.e., 18/03/2023. After discussion both parties settled the matter. The grievance of the complainant was in respect of the purchase of a smart TV. As per the settlement the opposite party has agreed to deliver a new Impex Onix UB Smart TV with 1 year warranty to the complainant and the complainant has agreed to pay an amount of Rs.2,000/- at the time of delivery of new TV at his residence. Both these conditions are to be fulfilled by both the parties on or before 29/03/2023. As per the settlement it was also agreed that the opposite party can take back the old TV after delivering the new TV to the complainant. The compromise memo signed by both parties is accepted and recorded. In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be allowed in terms of compromise memo dated 18/03/2023.
In the result complaint is allowed in terms of compromise. The memo dated 18/03/2023 filed by the parties to the proceedings will form part of this Order.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
