Smt. A. Nanda, Member (W): - The brief facts of the consumer complaint is that, the complainant purchased one “Shri Siddh Hanuman Chalisa” from the O.P.No.1 for his son, Sritam Rana through mobile after seeing the advertisement in Television on dtd. 31.03.2017. The agent/supplier (O.P.No.3) has delivered the product on dtd. 01.04.2017 by receiving Rs.1,690/- only. After opening the packet at home the complainant found that the said product was a duplicate one. The complainant contacted with the O.Ps but the O.Ps did not care about the complainant, hence the complainant filed this case.
Being noticed through this Forum, the O.Ps. neither appeared before this Forum nor submitted their written statement, hence the O.Ps stand set ex-parte.
Heard from the complainant. The complainant filed cash voucher of the product ‘Hanuman Chalisa’ worth Rs. 1,590/- only issued by the O.P No.1 having VAT TIN NO. 21784302344 in the name of son of complainant, Sritam Rana. The said Hanuman Chalisa was not exactly as seen in the Television. The features of the said Hanuman Chalisa were also not having as taught in the advertisement of the Television. After receiving notice from this forum the O.Ps remained silent. The complainant shown the said Hanuman Chalisa before this forum. Such types of advertisements and delivering the duplicate product should be discouraged. The O.Ps have committed unfair trade practice towards the complainant.
Hence this Hon’ble Forum allow the complaint petition with directions to the O.P.No.1 to refund Rs. 1,590/- (Rupees one thousand five hundred ninety) only towards the price of Hanuman Chalisa alongwith pay a sum of Rs.2,000/- (Rupees two thousand) only towards harassment, mental agony and cost of the case with in 30(thirty) days from the date of receiving of this order failing which the O.P.No.1 shall be liable for interest @12% p.a on the awarded amounts till realization.
Accordingly the case is disposed of.
Order pronounced in the open court today on this the 10th day of August 2017, copy of this order shall be communicated to the parties as per Rule.
