            The case of the complainant presented on 13-9-11 is as follows.
            She had purchased churidar worth Rs.820/- and dhoti worth Rs.270/- on 6/9/11 from the opposite party. The churidar not suitable when it was wearing. She had purchased the churidar with the assurance made by the staff of the opposite party that if any defects occurred the churidar will be replaced by the opposite party. The opposite party was very adamant stand to replace the churidar. Moreover they treated the complainant as a stranger.    There was clear deficiency in service on the part of the opposite party. The complainant sustained loss and sufferings. Hence this complaint.
            The notice was served with the opposite party. They appeared. Three postings but they did not file any version and there after they did not turned up.
            The complainant examined as PW1. The purchase bill which was marked as Ext.A1.
            Heard complainant. The case of the complainant is that the churidar became not suit for her when it was wearing. According to her the assurance made by the opposite party was that they would replace the churidar if any defects occurred. The opposite party was not contest the case properly even after accepting the notice. Hence we have no reasons to dis-believe the case of the complainant. So we are of the opinion that the case of the complainant is to be allowed.
            In the result the complaint is allowed as follows. We direct the opposite party to refund Rs.820/- to the complainant and pay Rs.500/- as compensation for inconveniences and pay Rs.250/- as cost of these proceedings. The order shall be complied with within a period of one month from the date of receipt of a copy of this order. The order not complied with one month the amount will carry interest @ 10% per annum from the date of order till the date of payment.
