JUDGEMENT

Mr. Purna Chandra Mishra, President.

          Complainant Basudev Sahani has filed this case U/s 35 of CP Act-2019 alleging deficiency of service on the part of Opposite Parties for making wrong entry in the Registration Certificate of the vehicle praying therein for direction to the OP No. 1 to pay Rs. 10, 000/- in Registration papers, Rs. 2000/- towards cost of litigation and Rs.50,000/- towards mental agony.

1. Brief fact leading to the case is that the complainant purchased one Bajaj Pulser-150 motorcycle from the OP No. 1 on 25.01.2016 for consideration of Rs. 85388/-. Because of issue of wrong sale letter, there was error in Registration Certificate for which, he could not book the HSRP. Therefore, he filed this case before this Commission for the reliefs as discussed above.
2. Notice was duly served on the Opposite Parties. But, the OP No. 1 did not appear nor challenged the allegation raised against him in any manner. The OP No. 2 appeared in person and filed his show-cause. The OP No. 2 in his show-cause stated that the complainant is the rightful owner of the motorcycle bearing Registration No. OD12A-1881 and booking of HSRP failed as because the maker’s name was mentioned as “others” instead of “Bajaj Auto Ltd.” In the meantime, necessary correction has already been effected and therefore, he prayed for disposal of this case.
3. The principal grievance of the complainant has already been redressed and it is just a typing error and it has already been corrected by the competent authority and hence the order.

ORDER

          The complaint petition is disposed of with direction to the Opposite Parties not to commit such type of error and be careful in future. Parties to bear their own cost.
