Deficiency in LPG gas service is the grievance of the petitioner.

            The facts of the complainant as per  complaint petition  shortly  is that the petitioner is a bonafied consumer under the O.P from 16.04.14 vide consumer No.601089 for domestic purpose . That after receiving gas pass book and bond from the O.p the petitioner availed domestic gas till 25.07.2018 . On dt. 25.07.18 the O.P delivered last LPG gas to the petitioner .  Subsequently  the petitioner wants   to buy another filling cylinder from the O.P but the O.P denied to provide LPG gas without any valid reason . Thereafter the petitioner  has been harassed  due to negligent  of the O.P. Further  the petitioner sent a legal notice on 26.03.19  through Regd post with A.D only to settle the  dispute amicably but the O.p did not respond or reply the notice .

            Finding no other alternative the petitioner knocked the door of this commission with the prayer to direct the O.P to provide LPG gas  along with compensate  as deemed fit.

Though notice was duly served on the O.P but the O.p  neither appeared nor  choose to file written version or objection within the specific time fixed by this commission . Accordingly  the O.p has been  set-exparte dt. 05.12.19. by the order of this commission.

            On the date of hearing no step taken by both the parties .After perusal of the record and documents in details  it is observed that

It is undisputed fact that the petitioner is a domestic LPG gas consumer under the O.p.

As per the gas card the petitioner availed filling LPG cylinder dt.25.07.18 . On the other hand the O.P neither appeared nor filed objection or written version against the complaint in the  complaint petition mentioned by the petitioner. Accordingly there is no scope remain before this commission to accept the uncontroverted statement  mentioned in the complaint petition as per observation 

of the appellant Forum stated below:-

2003-CLT-V0l-96-p,15-para-4 –C.D.no.37/02, SCDRC, Odisha, wherein it is held that

“Absence of written version  commission is bound to accept the uncontroverted  statement made in the complaint petition “.

            2013(1)CPR-507-N.C , wherein it is held that :

            “ In case written version  not filed after  several opportunity it has no defense on merit “.

Hence this Order

            The dispute is allowed against the O.P as exparte. The O.P is directed to provide LPG gas cylinder to the petitioner within one month after receipt of this order, failing which the O.P is liable to pay compensation of Rs.10,000/-( ten thousand) to the petitioner. The petitioner can recover the same by initiating the proceeding as per law, in case non compliance of the order.           

            This order is pronounced in the open Forum on this the  28th  day of  August,2020. under my hand and seal of the commission.
