The Complainant is absent without taking any step.

None appears on behalf of the Complainant on repeated calls.

It appears that the Complainant remain absent on four consecutive days.

Show cause Notice was issued. No reply is received from the end of the Complainant.

It appears that the Complainant received the mobile hand set from the O.P.

The Ld. Agent for the O.P files hazira.

It appears from the C/R that the Complainant files this case with a prayer for replacing the defective handset with compensation and cost. Once he filed a petition for amendment his plaint but none moves the said petition.

Thus, considering the facts and circumstances of this case, it appears that the Complainant did not come forward before this Forum since 28/06/2016. Today also the Complainant is absent. No step is taken by the Complainant.

In our view, the Complainant has no allegation against the O.P also received the mobile handset in question with full satisfaction.

Thus the present case deserves to be dismissed.

Hence,

           it is ORDERED that,

                          the present Case No. CC/114/2015 be and the same is dismissed and disposed off accordingly. No order as to costs.

           Let plain copy of this Final Order be made available and be supplied free of cost, to the concerned party.
