                                                            JUDGMENT

                        The facts of the complaint in brief is that  the complainant has purchased  one mobile phone Lava  Irish XI  Vide Case memo No.434 on dt. 30.06.2015 from the authorized dealer  O.P.No.1 with a consideration of Rs.7,000/-. But to his utter surprise within four months of its the set started trouble and did not function properly   and immediately the complainant approached the O.p No.1 but the O.p No.1  requested to approach the Service Centre at Rayagada. On the request of the O.P 1 the complainant approached the O.P 3 to rectify the defect. The complainant approached  O.p 3 number of times but there was no positive action as such the complainant was caused mental agony and financial loss and  finding no other option  approached this forum for relief  and prayed  to direct the O.Ps  to replace  the defective mobile set with a new one and  pay compensations   for mental agony and award cost of the litigation.

                        On being  noticed by this forum the opposite party remained silent and did not turn of to file any written version. In absence of any written version from the opposite party we proceeded the matter exparte and believed the allegations of the complainant and hence, we passed the order and dispose of the matter with the following directions.

                                                                 

                                               

                                                               ORDER

                        The  Opposite Parties  are directed to replace the mobile set of the same model with fresh warranty   within one month from the date of receipt of this order, failing which the  complainant has liberty to file execution proceeding U/s 27 of the C.P Act,1986.                  Pronounced in open forum today on this 13hday of January,2016 under the seal and signature of this forum.

                         A copy of this order as per the statutory requirements be forwarded to the parties    free of charge.
